The Malaysian Insight quoted Tan Sri Muhyiddin Yassin as saying certain quarters think the memorandum of understanding signed by members of the unity government is unconstitutional.

MPs should be free to air their views without the threat of losing their positions as lawmakers, he added. 

The Perikatan Nasional chairman further highlighted that the unity government agreement coalition members signed on December 16 would be irrelevant if Prime Minister Datuk Seri Anwar Ibrahim has the numbers to back his administration.  

Responding to comments from certain quarters, Deputy Prime Minister Datuk Seri Fadillah Yusof says the main objective of the agreement was to ensure political stability, and a positive impact on the people and the national economy.

Therefore, allegations that the co-operation agreement to formalise the unity government is unconstitutional and will lead to dictatorship are untrue, Fadillah said yesterday, as reported by Bernama. 

According to Fadillah, the agreement clearly states that all component parties in the government can still negotiate with each other to reach a consensus.

He said opposition parties who thought otherwise can take the matter to court.

“In the agreement, it states that any party (in the government) that is not satisfied must negotiate with all the parties that make up the unity government, so we will negotiate.

“To ensure political stability, we need to ensure there will be no vote of no confidence (against Prime Minister Anwar Ibrahim).

“We have had three prime ministers (in two years) and one of the reasons is because of the vote of no confidence issue,” he told a media conference in Kuching yesterday.

Fadillah said the main objective of the agreement was to ensure political stability that in turn would bring about a positive impact on the people and the national economy, adding that he would be tabling the motion of vote of confidence in the prime minister on Monday, December 19, 2022.

He also hoped that the unity government would last until the end of the current term and focus on good governance of the country.

In a statement earlier yesterday, Masjid Tanah MP Mas Ermieyati Samsudin claimed that the agreement was a prelude to dictatorship, adding that it was also illegal, dangerous and unenforceable.

The Bersatu Srikandi vice chief said clause 4 of the agreement stated that all MPs are required to vote or support the prime minister in motions relating to confidence votes, supply bills or procedural motions with effect on the federal government’s stability.

“According to clause 4(b), if any government MP fails to vote as instructed, they will be deemed to have vacated their parliamentary seat based on article 49A of the Federal Constitution,” the former deputy minister in the Prime Minister's Department said.

Representing 22,000 lawyers, Malaysian Bar to challenge Pardons Board's reduced Najib's jail sentence and fine

Media reported the Malaysian Bar has filed for judicial review to challenge the decision of the Federal Territories Pardons Board (FTPB) to halve former prime minister Datuk Seri Mohd Najib Tun Abdul Razak’s jail sentence and reduce the fine in his SRC International corruption conviction. In the application filed by solicitors Messrs Amir & Rajpal Ghat in the High Court last Friday, the Bar, which represents 22,000 lawyers practising in Peninsular Malaysia, sought a declaration that the board’s collective decision was unlawful, unconstitutional and void, according to FMT . It also requested an order of certiorari against the board to quash the FTPB’s decision. The board and Najib are named as respondents to the application. The Bar also wants a permanent injunction restraining Najib or his agents from submitting any application for pardon, reprieve or respite to the board until all criminal charges against him have been exhausted. Memalukan kerajaan negeri Johor, kata Menteri Besar Akhbar Harian Metro semalam melaporkan Menteri Besar Johor Datuk Onn Hafiz Ghazi menyifatkan insiden gangguan bekalan elektrik di Kompleks Kastam, Imigresen dan Kuarantin (CIQ) Bangunan Sultan Iskandar (BSI) Tambak Johor sebagai memalukan kerajaan negeri. Katanya, beliau telah mengarahkan pihak Tenaga Nasional Berhad (TNB) dan Jabatan Kerja Raya (JKR) diarahkan menyelesaikan isu terbabit.
