CONSTITUTION DOESN'T SPECIFY SUNNI OR SYIAH - UNLESS Religious Authorities Could Clarify Specifically And Satisfactorily That Syiah Is Wrong And Un-Islamic

The Syiah Controversy In Malaysia

FORMER Court of Appeal Judge Hishamudin Yunus said it was wrong for the authorities to detain Syiah Muslims as Article 3 of the Federal Constitution, does not state which branch of Islam was official.

From legal perspective

"I will just approach this issue as a former judge, from a legal perspective. Firstly, Article 3 of the Federal Constitution says Islam shall be the religion of the Federation and other faiths may be practiced.

The word there is 'Islam'. It doesn't say 'Sunni Islam', it doesn't say 'Syiah Islam', it just says 'Islam'.

"The word Islam has yet to be, one day it will have to be, interpreted by the supreme court (to say) what is meant by Islam," he said during a public forum held as part of Human Rights Commission's (Suhakam) 20th-anniversary event in Kuala Lumpur on the day-before-yesterday, Thursday 12 September 2019.

Another Suhakam member, Nik Salida Suhaila Nik Saleh said Suhakam does not interfere matters related to Islam. Suhakam and Islamic authorities are agreeable to each other on many aspects, including LGBT issue.

Suhakam's recent criticism

Jais raid

Hishamudin, who is a member of the commission, was responding to a question about the Suhakam's recent criticism of the raids conducted by the Selangor Islamic Religious Council (Jais) on a raid in Gombak on Friday, 6 September 2019, which saw 23 people being arrested, including Syiah Malaysia chairman Kamil Zùhairi Abdul Azizi.

Certain parties observed the arrest as "bully" practiced by the religious authorities. Syiah Islam is considered by the religious authorities to be deviant.



Hishamudin's personal view

Emphasising that this was his personal view, Hishamudin said Islam should not be confined to Sunni Islam in the absence of a court interpretation.


He also called for the raids on Syiah Muslims to stop.

Amman Message

Elaborating, Hishamudin opined that authorities ought to consider the Amman Message's stance on Syiah.


200 Islamic Scholars from 50 Muslim countries recognised Syiah as legitimate


The Amman Message is a statement on the faith by about 200 Islamic scholars from 50 Muslim countries worldwide. Initiated by Jordan's King Abdullah II in 2004, it recognised two strands of Syiah Islam as legitimate.

Malaysia endorsed the document in 2005. The then prime minister, Abdullah Ahmad Badawi signed the said document. During his tenure, Badawi introduced a special concept of Islam named Islam Hadhari.

Syiah Muslims from many countries, as usual, perform haj and umrah with permission from the Saudi Arabian authorities, except cases involved terrorism.

Mujahid respects decision and action by Jais

Yesterday, Friday 13 September 2019, Minister In The Prime Minister's Department Dr Mujahid Yusof Rawa commented that the Selangor Islamic Religious Council (Jais) raid in Gombak was in accordance with the standard operating procedures (SOP) and it was under the purview of the state authorities. He added that he should respect the decision and action carried out by Jais.

Careful consideration

Therefore, after careful consideration, Permadu Malaysia believes that a combination of states and federal Islamic religion authorities must furnish the public, especially Muslims, a conclusive clarification, specifically and satisfactorily, based on Islamic teachings, including Al Quran and Prophet Muhammad's genuine hadiths, that Syiah is wrong and un-Islamic.

Fair treatment

The Syiah Islamic scholar(s) must also be given the opportunity to answer and explain on why Syiah should be recognised in Malaysia as one branch of Islam.

Action against Syiah does not mean it violated the Constitution that allows practice of other faiths

Ordinary Muslims in the country are getting confused with the Syiah controversy. Whether or not Syiah is part of Islam, or it complies the true teachings of Islam, or it is un-Islamic, it has nothing to do with the Constitution that guaranteed the practice of other faiths in this country.

Syiah implicates Islam

Syiah is a different issue because it implicates Islam. Syiah in Malaysia has become a sensitive issue to be discussed openly by those without adequate religious knowledge and background so as to avoid confusion among Muslims.

Syiah's future in Malaysia

If Syiah practice in Malaysia can prove that they are strictly one of the two strands of Syiah compliant, which were recognised as legitimate by the Amman Message in 2004, and later in 2005, the document was endorsed by Malaysia, they would have a good chance to win the case.

If they are not, everybody should know the answer.

To the authorities concerned, handle with care, trustworthy, honesty and integrity. It is all for Allah. There is no god but Allah, Prophet Muhammad is the messenger for Allah.

    Interesting take on Syiah matters. It is known for a long time that the Sunni and Syiah conflict has existed and despite many efforts of religious scholars from both Sunni and Syiah to discuss and despite intervention of politicians from Muslim countries to obtain clarity, none has come to a satisfactory conclusion.

    therefore, the current status quo in Malaysia to maintain Ahli Sunnah Wal Jamaah as the only one practised in Malaysia and not allowing Syiah to prosper in Malaysia must be supported. Allowing Syiah to propagate their teaching will only introduce chaos and highly likely, increased animosity and hatred among the muslims here in Malaysia.

    Whether Syiah is regarded as a deviant teaching or otherwise is not a consideration. There is nothing wrong with ASWJ as being practised here in Malaysia. Since there is nothing wrong with AWSJ, why do we want to entertain Syiah and open a pandora box?

    For those that has chosen to practise Syiah, they should be prevented and discouraged from propagating their belief.
