Malaysian AG seeks an audience with King on Najib's conditional pardon and house arrest
AG is expected to explain the technical issues regarding the implementation of Najib's house arrest
Media reported today that Attorney General (AG) Tan Sri Mohd Dusuki Mokhtar (picture, above) has apologized and stated his stance to comply with the conditional pardon order for the country's sixth Prime Minister, Datuk Seri Mohd Najib Tun Abdul Razak, as decreed by the Yang di-Pertuan Agong, the official title of the Malaysian King.
The Prime Minister's Office, through a statement today, also emphasized that the AG has requested an audience with the Yang di-Pertuan Agong, Sultan Ibrahim (picture, top), regarding the error or oversight in the matter.
"The Attorney General will also explain the legal questions arising from the High Court's release order following the payment of the RM50 million (USD12.5 million) fine, which needs to be decided by the court.
"This is because it affects the start date of the prison sentence in the 1Malaysia Development Berhad (1MDB) case," it said.
Earlier, the Palace decreed that any argument questioning the conditional pardon order against Najib is considered an act of defying the order of the Yang di-Pertuan Agong, Sultan Ibrahim.
This is because all conditions in the conditional pardon order have been met, and its implementation should not cause prolonged confusion or uncertainty.
The decree also emphasized that the pardon order is clear, explicit, and free from any ambiguity, and has no relation to any other cases faced by Najib.
Yesterday, media reported that UMNO confirmed the RM50 million fine payment process had been settled at the Kuala Lumpur High Court as a condition for Najib to undergo house arrest.
However, the Attorney General's Chambers (AGC) was later reported to have temporarily deferred the implementation of house arrest for Najib to obtain further clarification regarding the interpretation of the conditional pardon order granted by Sultan Ibrahim.
The AGC was quoted as saying the deferment was made following legal questions regarding the interpretation of the order, especially concerning the effect of the RM50 million fine payment on the remainder of Najib's prison sentence for the SRC International case.
On 18 September, the Pardons Board for the Federal Territories of Kuala Lumpur, Labuan, and Putrajaya examined Najib's petition under Article 42 of the Federal Constitution.
