Daim’s family withdraws stay application after Sessions Court halts forfeiture proceedings
The Edge reported the late former finance minister Tun Daim Zainuddin, his wife, Toh Puan Na’imah Abdul Khalid and their next of kin withdrew yesterday, Wednesday 15 April 2026, their application for a stay of four forfeiture proceedings at the High Court, which had been filed against them and their companies by the Malaysian Anti Corruption Commission (MACC) and government.
This follows the Sessions Court having earlier granted their application for a stay of proceedings earlier this month, as well as four separate MACC forfeiture applications, pending the disposal of the judicial review applications that it filed in 2024 and the constitutional reference matter.
Judge Datuk Aliza Sulaiman allowed the withdrawal and ordered the plaintiffs in the action to pay RM2,000 costs to the MACC and government in online proceedings.
Besides Daim, who died in November 2024 and Na’imah, other plaintiffs in the action include their four children Asnida, Md Wira Dani, Muhammed Amir Zainuddin and Muhammed Amin Zainuddin, along with 18 companies.
The 18 companies are AAD Equity Sdn Bhd, Yayasan Haji Zainuddin, Ilham Baru Sdn Bhd, Anchor Point Sdn Bhd, Kangkung Catering Sdn Bhd, Adrihaniz Sdn Bhd, Syarikat Malur Sdn Bhd, Amiraz Sdn Bhd, Ridana Sdn Bhd, Daan Sdn Bhd, Maya Seni Holdings Sdn Bhd, Magical Zone Sdn Bhd, Permatang Maju (M) Sdn Bhd, Brainstorms Sdn Bhd, Arida Farms Sdn Bhd, Gajah3 Resource Centre Sdn Bhd, Ilham Tower Sdn Bhd and Selidik Jaya Sdn Bhd.
Besides naming the MACC and government, they also named present MACC chief commissioner Tan Sri Azam Baki and Prime Minister Datuk Seri Anwar Ibrahim and two other senior MACC officers in the judicial review application.
The Edge said they were not allowed to attend the online proceedings but Na’imah’s counsel Encik Nizamuddin Abdul Hamid and lawyer Encik Abraham Au separately confirmed Wednesday’s outcome when contacted by the business news portal.
“It’s a stay against MACC forfeiture proceedings. We withdrew our application at the High Court because we have obtained stay at four separate Sessions Court for the forfeiture,” Nizamuddin said.
Federal counsel Encik Mohammad Sallehuddin Md Ali appeared for the MACC and government.
It is understood that one of the stay of forfeiture proceedings granted involved Ilham Baru and Sinar Lestari Sdn Bhd.
However, it is not known how many companies or assets the MACC had sought to forfeit as the plaintiffs had also filed a protective order against naming the assets.
Leave granted in November on judicial review
The forfeiture notices had been issued by the MACC since 2024, with the last believed to have been issued last December.
The stay was sought pending a reference of constitutional issues to be determined by the Federal Court and two separate judicial review proceedings filed in 2024.
On 5 November, Aliza allowed leave for judicial review for Daim, Na’imah and the others named above, challenging the freezing of their various accounts in relation to the MACC's investigation into their finances.
Aliza had said that the applicants in this case had passed the higher threshold in the legal challenge to ongoing criminal probes by investigating authorities.
"Leave to commence judicial review is allowed," she said, adding that the issues raised needed to be fully ventilated before the court.
The judge granted permission for the substantive arguments or merits of the judicial review to be heard, after finding that there were elements in the MACC’s freezing order, made under the MACC Act, that was extended under provisions of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activity.
Prior to this, it was reported that Daim and Na’imah were separately charged at the Sessions Court in 2024 under Section 36 of the MACC Act for not disclosing their assets.
The charge against Daim was withdrawn after he passed away.
However, earlier this month, Asnida had been charged with the same offence where she also claimed trial.
