Berjaya considers the action to forfeit its land ownership in Pahang 'unreasonable, unacceptable'.

Berjaya Hills Resort Bhd, a subsidiary of Berjaya Corp Bhd—a conglomerate founded by tycoon Tan Sri Vincent Tan Chee Yioun—insisted that the enforcement action taken against its property by the Pahang authorities was "unreasonable and completely unacceptable," according to a report by the prestigious Malay-language newspaper, Berita Harian, on Friday, 2 October 2026.

The action, taken following a dispute over a sharp increase in land tax, was also 'unreasonable' and undermined Berjaya Hills' legitimate expectation to continue its business and operations peacefully, the newspaper quoted the company as saying in a statement.

The statement was issued following the forfeiture of the premises on 28 September.

"Such a step by the Pahang state government will have a negative impact and affect future investments by local and foreign investors in the state of Pahang," said Berjaya Hills.

Berjaya Hills owns land and operates hotels and resorts in highland destinations near Bentong, including Colmar Tropicale, The Chateau Spa & Wellness Resort and Berjaya Hills Golf Resort.

For now, Berjaya Hills has obtained a temporary stay on the forfeiture covering staff quarters, a central laundry and other key facilities, while the company applies to have its case heard in Malaysia's highest court after suffering recent defeats in the High Court and Court of Appeal.

The dispute stemmed from a 13-fold increase in quit rent (land tax) on the Berjaya Hills property to RM33.7 million in 2020 compared to the previous year, which the company described as 'extraordinary and unprecedented' in Malaysia.

The amount was later reduced to RM25.75 million, but it was still an increase of nearly 10-fold after 11 appeals were submitted to the Pahang state government between April 2020 and December 2022, based on the chronology provided by the company.

Berjaya Hills continued to submit appeals without success, before challenging the quit rent assessment in the High Court in April 2023."

The effort failed when the court ruled that it could not interfere in the state government's policy decision regarding the revision of quit rent (land tax) rates.

The company then took its case to the court of appeal but lost in a ruling last July.

An application for leave to bring the matter to the Federal Court was made in August this year, with the hearing scheduled for 8 December.

While Berjaya Hills hopes the legal action will yield a positive outcome, the company said it earnestly hopes the Pahang state government will continue to negotiate constructively with the company toward a mutually acceptable and amicable settlement.

The media reported that 122 land titles owned by Berjaya around Bukit Tinggi, Bentong, were forfeited to the Pahang State Government following the failure to settle land tax arrears totaling more than RM70 million.

The Head of the Pahang State Enforcement Unit (UPNP), Encik Saifullah Muhammad Ali, said that among the locations involved are workers' quarters, a laundry, a rabbit park, and a Japanese garden, each of which is located on forfeited government land.

"On 28 September 2026, the Pahang State Enforcement Unit (UPNP) carried out enforcement action on land owned by Berjaya Sdn Bhd in Bukit Tinggi, which had been forfeited to the Pahang State Government.

"A total of 122 forfeited property titles have been seized, while permanent structures on government land have been vacated and locked up using chains and padlocks.

"The action was carried out after Berjaya failed to settle land tax arrears amounting to RM70,481,097 involving a total of 122 property titles, which have been overdue as early as 2020," he said.
