The Star reported today a businessman has claimed trial at the Sessions Court here to a charge of criminal breach of trust involving RM37mil, four years ago.
Datuk Seri Zul Azmi Abu Hussin, 51, was accused of committing CBT involving RM37,099,999.67, which was entrusted to him in his capacity as the director of Xspec Resources Sdn Bhd.
He allegedly committed the offence at a bank in Taman Tunku, Bukit Tunku here on Feb 15, 2022.
He was charged under Section 409 of the Penal Code and faces a maximum of 20 years' imprisonment, whipping and a fine if convicted
Deputy public prosecutor Siti Suriatey Mohamed Yusoff offered bail at RM500,000 in one surety and sought for the court to impound the accused's passport pending the disposal of the case.
Meanwhile, lawyer Edly Mohammad Firdaus asked for a lower bail amount of RM50,000.
He said Zul Azmi is supporting his wife, five children and parents and has cholesterol issues and high blood pressure.
"My client has given his cooperation to the investigators. Bail should not be punitive to the accused. It is meant to guarantee his attendance in court," Edly said.
Sessions Court judge Mohd Kafli Che Ali allowed bail at RM100,000 in one surety and ordered the accused to surrender his passport to the court.
The case is fixed for mention on Oct 5.
