Ramkarpal continued the cross-examination of Gnanaraja.
Gnanaraja admitted that he attended Najib’s birthday party in Najib’s house in Kuala Lumpur in 2017.
He was not personally invited by Najib but went along to Najib’s house through Najib’s friends.
Najib did not know him nor has Najib got Gnanaraja’s handphone number.
Gnanaraja also does not have Najib’s handphone number.
And yet Gnanaraja had testified that he had represented to Datuk Zarul that he knew Najib.
Was he not lying? Gnanaraja had represented that in his WhatsApp messages to Zarul which was submitted by the prosecution in court.
However Gnanaraja had claimed otherwise in his previous testimony in this court that he was paid RM19 million in 3 instalments by Datuk Zarul as a friendly loan for Gnanaraja’s personal use.
Gnanaraja said he had no documents to show that it was a friendly loan.
Gnanaraja said there were no terms as to when repayment was to be made nor the interest rate.
Gnanaraja states that he can pay back the RM19 million in 20 years if he so wishes, or any time as he likes.
That is illogical but Gnanaraja claims this is the case.
Gnanaraja could not produce the letter where he claimed in his testimony last week that he had replied to the legal letter of demand issued by Zarul against Gnanaraja demanding the return of RM19 million.
Gnanaraja admits he could not answer why he did not have the reply.
The claims in the legal notice of demand were then repeated in the cheating charge against Gnanaraja in the Shah Alam Sessions Court.
The timeline of the entire transaction shows that Gnanaraja received the first tranche of RM2 million from Zarul within a short time of Gnanaraja first meeting Zarul.
Gnanaraja then managed to get a total of RM19 million from Zarul to settle Zarul’s MACC case.
In exchange, Gnanaraja promised in the WhatsApp messages to settle the MACC case involving Zarul through an individual which Gnanaraja could not name nor remember.
However, Ramkarpal says that the WhatsApp messages mentioned the individual as the Prime Minister, which Gnanaraja now denies.
Gnanaraja now says that he is no longer a Datuk when he had earlier testified that his Datukship has been reinstated.
Gnanaraja admits that his mother-in-law, who is over 70 years old at that time, wanted to meet Lim Guan Eng at Gnanaraja’s house.
Gnanaraja’s mother-in-law was willing to wait until 2-3a.m. in the morning just to meet Lim Guan Eng without any compulsion from Gnanaraja.
Ramkarpal refers to Gnanaraja’s bankruptcy as a result of his failure to pay Messrs Dennis Nik & Wong, his then lawyer, an amount of RM5 million in legal fees.
His then lawyer had secured a lighter alternative charge relating to Gnanaraja’s cheating case involving Zarul’s RM19 million claim in the Shah Alam Sessions Court.
Gnanaraja had claimed that his lawyers did nothing at all to obtain the lighter alternative charges to his cheating charge.
Gnanaraja claimed that the lighter alternative charges were handled by Gnanaraja himself.
However, the court ruled against Gnanaraja in favour of Gnanaraja’s former lawyers that they have a right to the legal fees.
Upon non-payment of the RM5 million legal fees by Gnanaraja, Gnanaraja was then adjudged bankrupt.
Gnanaraja admitted that he had asked for the lighter alternative charges to the cheating charge in exchange for becoming a witness for the prosecution against Lim Guan Eng.
Ramkarpal claimed that the alternative charge was in exchange for Gnanaraja to offer false evidence against Lim Guan Eng.
Gnanaraja admitted that the money allegedly he had given to Lim Guan Eng was from Zarul.
Gnanaraja admitted that Zarul was present when the alleged money was handed over by Gnanaraja to Lim Guan Eng.
It does not make sense when Zarul was present and could have handed the money directly over to Lim Guan Eng without needing to go through Gnanaraja as a middle-man.
